These General Terms and Conditions of Sale govern the relationship between customers of the Josepha, Chagall, Knoebel, Simon and Jean d'Orbais apartments, located at 3 bis cours Anatole France in REIMS (51 100), and 3 bis cours Anatole France, a limited liability company registered with the REIMS Trade and Companies Register under number 418 873 857 00035, with its head office at 13 rue Cérès, REIMS (51 100). Acceptance of these general terms and conditions of sale implies the customer's agreement to the rules they govern. This acceptance is a necessary condition for booking a stay in the Josepha, Chagall, Knoebel, Simon and Jean d'Orbais accommodations. The reservation of a stay in one of the accommodations of SARL 3 bis cours Anatole France by telephone, e-mail, or by any other means of reservation, implies acceptance of these general conditions of sale. If the customer has booked their stay by telephone, they may be asked to formalize their acceptance of these general terms and conditions of sale by signature at check-in. More generally, these general terms and conditions of sale govern your stay in the Josepha, Chagall, Knoebel, Simon and Jean d'Orbais accommodations of SARL 3 bis cours Anatole France. Each customer acknowledges having read and accepted them.
The duration of the stay is determined between the parties at the time of booking. The customer will not be able to claim any right of maintenance in the places.
The prices indicated are in euros and include VAT applicable on the day of the reservation. Any change in the applicable rate, or any modification or introduction of new legal taxes by the competent authorities, will be automatically reflected in the prices indicated on the date of invoicing.
Reservations for stays at the Chagall, Knoebel, Simon and Jean d'Orbais accommodations are subject to and become effective upon payment by the customer of a deposit of 50% of the total price of the stay: - By cheque, payable to SARL 3 bis Cours Anatole France, to be sent to : SARL 3 bis Cours Anatole France, 13 rue Cérès, 51100 Reims, - By bank transfer to : ACCOUNT HOLDER: SARL 3 bis Cours Anatole France DOMICILIATION: CIC BANQUE PRIVEE REIMS IBAN: FR76 3008 7337 0000 0220 4430 154 BIC: CMCIFRPP, - By credit card, to SARL 3 bis Cours Anatole France, 13 rue Cérès, REIMS. For further information, please contact +33781865496; The total balance must be sent to SARL 3 bis cours Anatole France within 30 days of the scheduled arrival date, by cheque or bank transfer. Notification of the balance payment request will be sent by e-mail to the customer 40 days before arrival. For this purpose, it is specified that the reservation will only become final upon receipt of the balance, 30 days before the start of the stay. Should this not be the case, SARL 3 bis cours Anatole France reserves the right to dispose of the accommodation and offer it for rental again. In such a case, the deposit paid at the time of booking will remain due. In the case of short-term bookings, the full amount must be paid without delay. To the price of the stay is added the tourist tax, determined by a decision of the municipal council of the commune, and enabling it to finance expenses linked to tourist frequentation or the protection of their natural tourist areas for the purpose of tourism. For the commune of REIMS, this is set at €3.3 per person per night, and is payable on arrival at SARL 3 bis cours Anatole France. Minors are exempt from paying this tax. An e-mail confirming receipt of payment, including a detailed presentation of the accommodation booked, will be sent to the customer, and will have the value of a contract between SARL 3 bis cours Anatole France and the customer. Booking implies acceptance of these general terms and conditions of sale.
Check-in is carried out between 4pm and 8pm. Depending on the circumstances and if possible, exceptions to this rule may be made, after the customer has contacted SARL 3 bis cours Anatole France to inform them of their situation, on the following number: Mr Potdevin Benjamin Maître de Maison on +33 (0)781865496. Early check-in may be requested from 1pm for €275 incl. VAT. Under no circumstances can a customer's late arrival justify a request for reimbursement.
The check-out time is 12:00. No derogation will be granted for a departure beyond 12:00 am, for reasons of good organization and for the comfort of all customers. Exceptionally and if the availability of the rooms allows it, a maintenance in the places could be granted by the SARL 3 bis cours Anatole France, on the spot, against the payment by the customer of the night or the additional nights.
For reservations made by phone or internet, the customer does not benefit from the withdrawal period, and this in accordance with Article L121-21-8 of the Consumer Code relating to the provision of accommodation services provided on a date or according to a specific period.
Any modification of the stay is possible only with the agreement of the SARL 3 bis cours Anatole France and can involve additional expenses. Without that the customer cannot prevail himself of any compensation, the SARL 3 bis cours Anatole France reserves the possibility of changing the lodging initially reserved by the customer by a lodging of same or higher capacity. In such a case, the cost of the reservation remains unchanged.
Cancellation by the customer
Any cancellation must be notified by mail or email to the SARL 3 bis cours Anatole France. In the event of cancellation before the beginning of the stay, it will be due by the customer an allowance fixed in the following way: o If the cancellation intervenes until 30 days before the date of arrival, the installment versed at the time of the reservation will remain due to the limited liability company 3 bis cours Anatole France; no additional expenses will be put at his load, o If the cancellation intervenes less than 30 days before the beginning of the stay, the balance will remain due to the limited liability company 3 bis cours Anatole France. If the customer does not show up before 9:00 pm on the day planned for his arrival, the present contract will be considered as null and void and the SARL 3 bis cours Anatole France will be able to dispose of his apartment. The entire amount of the stay will be charged to the customer. In case of anticipated departure of the customer during the stay, the whole payment will remain acquired to the SARL 3 bis cours Anatole France. No cancellation insurance is included in the price of the stay. - Cancellation by the SARL 3 bis cours Anatole France If exceptionally the SARL 3 bis cours Anatole France were to be forced to cancel the stay, it will inform its customer by all means of communication as soon as possible. The customer will be immediately and completely refunded.
This contract is drawn up for a specific number of occupants, i.e. : - 4 people maximum for the Josepha apartment - 6 people maximum for the Chagall apartment - 4 people maximum for the Knoebel apartment - 6 people maximum for the Jean d'Orbais apartment - 6 people maximum for the Simon apartment If, on the day of arrival, the number of occupants is greater, SARL 3 bis cours Anatole France is entitled to refuse the additional occupants. This refusal can in no way be considered as a modification or breach of contract on the initiative of SARL 3 bis cours Anatole France, so that in the event of departure of the number of occupants refused, no reimbursement can be considered. Furthermore, any person not mentioned on the booking form will not be accepted by SARL 3 bis cours Anatole France without payment of an invoice for the price of the overnight stay. For safety and insurance reasons, any event (aperitif, cocktail, dinner, etc.) involving more than 6 people for the Chagall, Simon and Jean d'Orbais apartments, and more than 4 people for the Knoebel apartment, must be submitted to SARL 3 bis cours Anatole France for prior written approval, and must be organized exclusively by the company. The customer must specify the number of guests and the time slot for the reception when making the request. Under no circumstances may the rental agreed between the parties to the present contract be substituted, even partially, for third parties, whether individuals or legal entities, without the written agreement of SARL 3 bis cours Anatole France. Any infringement of this last paragraph may lead to the immediate termination of the rental agreement to the exclusive detriment of the customer, with the amount paid remaining the property of SARL 3 bis cours Anatole France.
Cleaning and laundry services are included in the price paid by the client to SARL 3 bis cours Anatole France. The consumptions and additional services not mentioned in the present contract will be settled at the beginning of the stay.
Pets are only accepted in certain apartments at an additional cost of €75 per animal, except in the case of guide dogs. Any customer who contravenes this rule by bringing a pet will be subject to the present terms and conditions of sale. SARL 3 bis cours Anatole France would then be entitled to refuse the customer, without any refund of the stay.
Booking a stay in the Josepha, Chagall, Simon, Jean d'Orbais and Knoebel accommodations implies prior acceptance of these rules, which govern the art of living in the accommodations and the use of the premises. To ensure the peace and quiet of the premises and the comfort of our guests, these rules must be respected by all. - No smoking or vaping in the apartments The rooms made available to guests are non-smoking. It is therefore strictly forbidden to smoke or vaporize in the rooms and communal areas, not only out of respect for the premises, but also for the comfort of our guests. Violation of this rule may result in the expulsion of the offending guest, without any right to claim reimbursement. - Respect for the premises and accommodation provided SARL 3 bis cours Anatole France does its utmost to welcome its customers in optimum conditions, in particular by providing them with clean accommodation in good condition, where it is pleasant to live. The customer undertakes to respect the peaceful nature of the premises and the comfort of neighbors, to use them in accordance with their intended purpose, and to return the accommodation provided in perfect condition. He also undertakes to declare systematically and assume financially any damage for which he may be responsible. In this respect, it is formally forbidden to: - use facilities such as the Jacuzzi to avoid noise pollution in the neighborhood between 10pm and 9am - organize parties or invite people who are not part of the group that has booked - make noise pollution: noises, loud shouts, music, particularly after 10pm - break or deliberately damage equipment in the apartments - disrespect the premises and common areas. In application of articles 1242 et seq. of the French Civil Code, any damage caused by the customer or by a minor in his care to the integrity of the premises made available to him will be at the customer's expense. The customer undertakes to comply with the etiquette set out in these general terms and conditions of sale, failing which he/she will be immediately evicted, the owners having the right to repossess the premises without reimbursement to the customer. Receptions are only authorized with the prior written agreement of SARL 3 bis cours Anatole France. - Behavior of customers and minors in their care Customers are entirely responsible for minors in their care. Customers undertake, for themselves and for minors in their care, to respect the peace and quiet of the premises and of other customers, by adopting irreproachable behavior. Any act attributable to a customer or to a minor in his/her care, which contravenes the rules of life in the accommodation, may result in his/her expulsion from the premises, without him/her being entitled to claim any reimbursement whatsoever.
The SARL 3 bis cours Anatole France does not engage its responsibility in the event of loss, flight, or damage to the goods of its customers or to its customers themselves, since it is not shown a link of causality between this damage and a fault of the SARL 3 bis cours Anatole France. In addition, the occurrence of a fact which gathers the elements of the force majeure exonerates the SARL 3 bis cours from any responsibility, and excludes any compensation of the customers, even if the facts occurred involve the interruption of the stay or the non-fulfillment of its obligations by the SARL 3 bis cours Anatole France.
The present general conditions of sale are governed by the French law. Consequently, any litigation which would occur between the SARL 3 bis cours Anatole France and one of its customers, within the framework of its stay, and relating to the interpretation or the execution of the present general conditions of sale, will be the exclusive competence of the Court of High Instance of Reims.
In accordance with the law n°78-17 of January 6, 1978 relating to data processing, the files and freedoms, the customer profits from a right of access and of correction of the data relating to it. The SARL 3 bis cours Anatole France makes a commitment not to communicate to other companies or organization the data which will have been transmitted by the customers.
The present general conditions of sale can be modified at any time and without notice. They are deemed accepted by the client from the moment he confirms his reservation.
